Removal Defense with Application for Bond
Removal Defense with Application for Bond
Removal proceedings—previously referred to as deportation or exclusion—are formal legal processes used to determine whether an individual may remain in the United States. These proceedings can be initiated against individuals seeking entry at the border, those who have overstayed visas, or lawful permanent residents who have been accused of violating immigration laws.

When facing removal, it is critical to understand that there are various forms of relief that may allow a person to remain in the country. Common defenses include:
- Cancellation of Removal (for lawful permanent residents and certain non-permanent residents)
- Adjustment of Status (changing from a temporary status to lawful permanent residency)
- Asylum, Withholding of Removal, or Protection under the Convention Against Torture
- Voluntary Departure (leaving the U.S. without a formal removal order)
In many cases, individuals placed in removal proceedings are detained by Immigration and Customs Enforcement (ICE) while their case is pending. However, detention is not always mandatory. By filing an application for an immigration bond, a detained individual may request release while awaiting their hearing.
A bond hearing before an immigration judge is an opportunity to demonstrate that the detained person:
- Does not pose a danger to the community
- Is not a flight risk
- Has strong ties to family, employment, or community in the United States
Bond amounts vary and are set at the judge’s discretion. An experienced immigration attorney can present evidence and arguments to secure the lowest reasonable bond and prepare a strong defense for the underlying removal case.
