DACA (Deferred Action for Childhood Arrivals)

DACA (Deferred Action for Childhood Arrivals)

Deferred Action for Childhood Arrivals (DACA) is a discretionary immigration program that provides temporary protection from deportation and work authorization for eligible individuals who were brought to the United States as children. DACA is a form of prosecutorial discretion, allowing recipients to live and work legally in the U.S. without fear of removal while their status remains active.

To qualify for DACA, applicants must meet the following criteria:

  • Arrived in the U.S. before turning 16 years old
  • Have continuously resided in the U.S. for at least five years prior to June 15, 2012, and be physically present on that date
  • Be under 31 years old as of June 15, 2012
  • Currently be enrolled in school, graduated from high school, obtained a GED, or be an honorably discharged veteran of the U.S. armed forces
  • Have no felony convictions, significant misdemeanors, or pose a threat to national security or public safety

DACA recipients are considered lawfully present for purposes of certain public benefits and are eligible to apply for Employment Authorization Documents (EADs), allowing them to work legally in the United States. While DACA does not provide a direct path to lawful permanent residency or citizenship, it offers important temporary relief and opportunities for young immigrants.
