Paid Surrogacy Arrangements Are Now Permitted In NY Under "Child-Parent Security Act of 2020"

New York law had criminalized surrogacy arrangements where a woman is paid for carrying a child.

It allows only “compassionate” surrogacy arrangements, in which the surrogate is not compensated, apart from limited expense assistance and medical reimbursement.

This has forced many families to travel to other states to take advantage of their compensated surrogacy regimes. The new law will allow paid surrogacy agreements in New York.

The new law --  Family Court Act § 581-406, states:

Upon the birth of a child conceived by assisted reproduction under a surrogacy agreement that complies with [CPSA requirements], each intended parent is, by operation of law, a parent of the child and neither the nor the spouse is a parent of the child.Family Court Act § 581-406
