Copyright

Copyright is a form of protection provided to authors of “original works of authorship” that are fixed in a tangible form of expression. Copyright covers both published and unpublished works.

What is covered under a copyright:

  • Literary works
  • Musical works, including any accompanying words
  • Dramatic works, including any accompanying music
  • Pantomimes and choreographic works
  • Pictorial, graphic, and sculptural works
  • Motion pictures and other audiovisual works
  • Sound recordings, which are works that result from the fixation of a series of musical, spoken, or other sounds
  • Architectural works.

What is NOT covered by a copyright:

  • Ideas, procedures, methods, systems, processes, concepts, principles, or discoveries
  • Works that are not fixed in a tangible form
  • Titles, names, short phrases, and slogans
  • Mere listings of ingredients or contents, among others.

Copyright owners have the exclusive right to:

  • Reproduce the work in copies
  • Perform and/or display the work publicly
  • Prepare derivative works based upon the work
  • Authorize others to exercise these exclusive rights
  • Distribute copies of the work to the public by sale or other transfer.

Copyright owners are entitled to statutory damages in case they prevail. A valid copyright registration is a prerequisite for suing for copyright infringement in federal court.

Our Copyright Services:

  1. Copyright Registration:
    • We assist clients in registering their copyrights with the U.S. Copyright Office, ensuring that their creative works are officially recognized and protected under federal law. Registration not only provides legal protection but also allows for the possibility of damages in cases of infringement.
  2. Copyright Infringement Enforcement:
    • When unauthorized use of your copyrighted work occurs, we take action to enforce your rights. This includes sending cease and desist letters, negotiating settlements, and, if necessary, pursuing litigation to stop the infringement and seek appropriate remedies.
  3. Licensing and Contracts:
    • Our attorneys draft, review, and negotiate licensing agreements that allow others to use your copyrighted works under specific terms and conditions. We ensure that your interests are protected and that you receive fair compensation for the use of your intellectual property.
  4. Copyright Litigation:
    • If disputes arise, our experienced litigators are prepared to represent you in court.
  5. Digital Rights Management:
    • In today’s digital age, protecting copyrighted works online is crucial. We advise clients on strategies for digital rights management, including the use of technology to prevent unauthorized copying and distribution of digital content.
