Imus (In The Morning) Sued By 78-Year-Old - Case Dismissed | DISCRIMINATION LAW UPDATE
This week’s case is about age discrimination in the entertainment industry.
Warner Wolf was a sportscaster for Imus for 20 years. Wolf moved out of New York during his last year with Imus and tried to do the show from Florida. Imus did not like it. He then fired the 78-year-old Wolf.
Wolf sued Imus for age discrimination under the very powerful N.Y. City and New York State Human Rights Law.
But, the only proof Wolf had was two comments made by Imus: “It was time to put Wolf out to pasture,” and “shoot him with an elephant dart gun.” Not enough.
The court dismissed the case and noted that the NYC and NY State anti-discrimination laws do not protect Wolf because at the time of the termination, he was neither employed in nor a resident of New York.
Wolf is now 80-years-old. Imus has retired.
